The Office for Environmental Protection believes Defra may have failed to comply with a number of environmental laws when granting emergency authorisations for use of a neonicotinoid pesticide in 2023 and 2024. In particular, the potential failures relate to Defra’s interpretation and application of the precautionary principle and compliance with its nature conservation obligations when it considered granting the emergency authorisations in 2023 and 2024. The investigation results from a complaint submitted to the OEP by ClientEarth.
